Every day Texans are seriously injured in car wrecks. Most of the time, these wrecks were entirely preventable. It is simply not enough to make a claim with the other driver’s insurance company and wait to see if it you feel any better. What many Texans do not realize is your delay in treatment will be used by the other driver’s insurance company and its team of lawyers to later argue that you were not injured. This is what we refer to as the “Delay, Deny and Defend.”
During the Delay phase, the other driver’s insurance company is very sympathetic and caring. They kindly ask you if they can take your recorded statement. They do not tell you that all of the questions they ask you are designed to avoid liability and put as much blame on you as possible. They also do not tell you that their recorded statement with their client, the other driver, is chalked full of suggestive reasons on why you were somehow equally to blame for being rear-ended. After the recorded statement, the adjuster advises you to send in all your medical bills so they can adequately evaluate your claim.
Once the medical bills are received, you enter the Deny phase. Their usual story is that based on their review of the police report they are denying 100 percent fault. In fact, even though their insured, the other driver, was cited by the police for causing the wreck – you are also at fault. After all, the police officer was not there to see the car wreck. If that was not bad enough, the insurance adjuster goes on to tell you that your delays and gaps in medical treatment are not going to be reimbursed.
Fed up and exhausted with the insurance company’s position, you threaten to get a lawyer. They tell you to go ahead. At this point, the insurance company’s defense lawyers receive the file and start preparing to Defend.
